Really??? Can anyone be this stupid... Defacing National Parks, and then she proves her stupidity by publishing it! I hope they ban her from any parks in the future.

I saw this on an article (via facebook) on the Backpacker Magazine site. Some of the comments under the article make me almost as sick as the damage itself.... some people just don't get it...

If you read just the headlines, you might get the impression that there is a serious debate going on about whether this is art or vandalism. Its a false dichotomy, set up mostly by those who are writing the headlines, not the authors of the actual stories. Any particular piece of work can of course be both art and vandalism. Most grafitti are acts of vandalism, and many are very good art as well. Sometimes vandalism itself can rise to the level of art; see The Monkey Wrench Gang and the destruction of the Berlin Wall.

But this crap Nocket has done? It would be vandalism if it were hanging in the Tate, MOMA or the library on Jr. High School Art Nite. It is pointless, rife with cultural appropriation, and embarrassingly unskilled. Nocket shouldn't worry about being a bad person. She should turn herself in and pray for about 10 years of community service: then she would at least have a day job.

If some of the comments are correct, this is second-generation-clueless.

I have theoried, always, that people who must 'leave their mark' -- carving into trees, placing locks on bridges, defacing landmarks -- know how insignificant and forgettable they are, hence, they must piss on a tree to mark that they even existed in the first place.

As sad as this is, its opportunity to tie the punishment to the crime and make an example out of her. The courts should order her sorry butt back to all these sites she defaced and start scrubbing. The fine should cover all cleaning supplies, supervision, and legal costs. Looks like it would take years for her to clean it up, based on the amount of damage she's done.

I agree that would be the appropriate punishment for the crime, though I am not sure about the courts' ability to fashion such a multi-jurisdiction sentence (maybe could be part of a plea bargain negotiated with the prosecution...). Also, I am not sure I want to see her unleashed in the parks again...at least not without a lot of supervision.

However, even if not, a criminal penalty can include restitution. The court could order, as part of any criminal conviction, that she pay the cost of clean up.

And cleaning it up, too.

Showing off is a fool's idea of glory.

It appears that our Miss Tagging Bragging's use of the social media backfired. Kind of like calling in sick to work and then posting yourself at a ballgame on Facebook while sick.

That's the interesting thing about her little art show spree... it may have been spread out over several states, but it's all on federal land. Therefore, the only jurisdiction issue here is what Federal Courthouse she's going to have to appear at.

As for punishment... I saw a suggestion by one of my favorite Sierra Dwellers that she be sentenced to picking up wag bags...

I think her community service should be delivering resupplies to the Woods Creek crossing every two days next summer.

And yes, any one court with jusrisdiction over any one of her federal offenses can hear and decide all of them.

And on the "innocent till proven guilty" standard; that's to keep the prosecutors and juries honest: the rest of us are entitled to our opinions.

Please take another look at my post. The issue I was addressing isn't the jurisdiction over the crimes, but the multi jurisdictional nature of the proposed sentence. Pretty sure a court could not order that sentence. However, perhaps it could be achieved as part of a plea bargain. If the NPS was willing to play chaperone. Which I doubt.

I do think it is the most appropriate sentence for the crime, even if it probably has to remain in the realm of hypothesis.

There's something positive about making a criminal perform restitution as directly related to their crime as possible. I wish our system was more geared toward that approach. Restitution in this case requires a lot of unskilled manual labor, and it destroys her "art." If her fine can cover NPS supervision and supply costs, then this seems like a good opportunity and great message to send out.

A sentence of picking up wag bags is hilarious. "Out of the bag" thinking. Gotta luv it.
